Maintain a CTIA-Compliant Privacy Policy
IMPORTANT NOTE
Please note: the FCC, CTIA, and the mobile network operators require SMS opt-ins, as well as data collected from SMS programs, be kept internal and not shared externally for promotional and marketing purposes. As part of the campaign review procedure, your websites and privacy policies will be reviewed by the campaign vetting agencies and the carriers.
If you already have a privacy policy, your privacy policy must comply with
Section 5.2.1 of the CTIA’s Messaging Principles and Best Practices and specify that
information obtained by SMS origination will not be shared with any third party for marketing or promotional purposes. If you do not have a privacy policy, you must publish one. We have provided the below information to assist. If you have questions regarding privacy policy, please reach out to our support team.
I already have a clearly published Privacy Policy on my website:
Insert Consent & Opt-Out Instructions
Your privacy policy must clearly specify that information obtained by SMS origination will not be shared with any third party for marketing or promotional purposes, and include opt-out instructions. It’s best to insert this verbiage below any details about sharing information with third parties or affiliates. When in doubt, insert this at the bottom of your privacy policy.
Recommended Verbiage:
Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates, both internal and external. For more information about our SMS campaigns, you can text HELP. If you wish to be removed from receiving future communications, you can opt out by texting STOP. Message frequency varies. Message and data rates may apply. |
I do not currently have a Privacy Policy on my website:
Start with Our Boilerplate
If you don't have an existing privacy policy, you can use the boilerplate we have written below. Make sure you swap out the yellow highlighted sections with relevant information as it pertains to your business, and make any other edits that you may deem necessary, while still ensuring you are compliant with carrier rules.
Once you have a Privacy Policy written, publish this privacy policy on your corporate website. If you do not have a corporate website, publish this privacy policy on the station website(s). Make sure you link to the privacy policy in the footer of your station websites. The link should be a clearly visible link labeled SMS Privacy Policy.
